Terms of Service

These Terms govern your access to and use of Kunbaa, operated by VRITUL PTY LTD, including the website, mobile apps, family tree tools, memories, posts, announcements, chat, calls, invites, events, tasks, Guru AI features, billing, and optional paid features. By using Kunbaa, you agree to these Terms. If you do not agree, do not use the service.

1. Your account

  • You must be old enough to use Kunbaa under the laws that apply to you. If you are under the age of majority in your area, use Kunbaa only with permission from a parent or guardian.
  • You must provide accurate account information, keep your sign-in methods secure, and tell us promptly if you believe your account has been compromised.
  • Kunbaa may link approved sign-in methods, such as email, mobile, Google, or Facebook verification, to the same account when the information matches.
  • You are responsible for activity on your account and for choosing relatives carefully when you invite them into a family space.

2. Family spaces, roles, and permissions

Kunbaa is built for private family collaboration. A family space may include family trees, member profiles, posts, memories, chat, events, tasks, billing context, and other shared information.

  • Family admins and invited members may have different controls depending on the product surface and settings available at the time.
  • You must respect the access settings, privacy expectations, and boundaries of other family members.
  • Do not add, share, or expose information about another person unless you have the right or appropriate permission to do so.
  • Use extra care with children's information, elder care notes, health details, identity documents, financial information, adoption context, family conflict, or other sensitive matters.

3. Your content

You keep ownership of the content you upload, post, send, or add to Kunbaa, including names, photos, videos, documents, recipes, voice notes, stories, messages, comments, events, tasks, and family-tree details.

You give Kunbaa a limited permission to host, store, process, display, transmit, back up, secure, and format your content as needed to operate, protect, improve, and support the service. This includes actions such as generating thumbnails, syncing across devices, delivering notifications, rendering family trees, enabling search, and sharing content with relatives you choose.

You are responsible for making sure your content is lawful, accurate enough for the use you make of it, and does not infringe another person's rights.

4. Acceptable use

You agree not to misuse Kunbaa. For example, you must not:

  • Break the law or violate another person's rights.
  • Upload malware, spam, abusive content, deceptive content, or anything designed to disrupt the service.
  • Harass, threaten, impersonate, exploit, or deceive other people through Kunbaa.
  • Scrape, copy in bulk, reverse engineer, overload, or try to access parts of Kunbaa you are not allowed to use.
  • Use Kunbaa for emergency response, professional medical advice, legal advice, financial advice, or safety-critical decisions.
  • Upload content that exploits children, violates privacy, promotes violence, or is otherwise unlawful or harmful.

5. Calls, messages, invites, and notifications

Kunbaa may let you send invitations, messages, announcements, comments, reactions, call requests, push notifications, and related family communications. You are responsible for using these features respectfully and lawfully.

If you invite someone from your contacts, make sure you are comfortable sending that invitation and sharing the related family context with that person.

6. Guru and AI-assisted features

Guru and other AI-assisted features can help with drafts, translation, summaries, interview prompts, event planning, and accessibility. These features are optional and may require a paid plan.

  • AI output may be incomplete, inaccurate, outdated, or unsuitable for your situation.
  • You remain responsible for reviewing AI-generated output before you post, share, send, rely on, or turn it into an event, task, or family-tree change.
  • Do not rely on AI output alone for health, legal, financial, safety, emergency, or other high-stakes decisions.
  • Guru access, token limits, voice availability, and context access may vary by plan, platform, territory, and feature status.

7. Paid features, billing, and refunds

  • Some features require a paid plan or add-on. Prices, usage limits, included features, token budgets, storage limits, and add-on availability may change over time.
  • Billing may be offered only in supported territories, supported storefronts, and supported product channels. Some mobile surfaces may remain informational until the required native purchase flow or local compliance work is complete.
  • If you subscribe, you authorize the applicable app store, Stripe, or other payment provider to charge you according to the terms shown at purchase, including taxes and recurring renewal terms where they apply.
  • Canceling a subscription stops future renewal but may not retroactively refund a billing period that has already started, unless required by law or the applicable storefront policy.
  • Nothing in these Terms limits non-excludable rights you may have under consumer protection laws, including Australian Consumer Law where it applies.
  • AI plans and add-ons may use technical guardrails such as monthly token budgets, weekly caps, rate limits, and abuse-prevention checks. If a budget is exhausted, some AI-assisted features may slow, stop, or fall back to non-AI behavior until the allowance resets or more capacity is added.

8. Public website monetization

Kunbaa may monetize public website pages with advertising, sponsorships, affiliate links, analytics, or campaign measurement where permitted by law and consent choices. Sponsored or affiliate placements should be labeled when used.

Signed-in family trees, private chats, private posts, private media, private events, private tasks, billing screens, and family admin areas are not third-party ad inventory. Read more in our Ads & Monetization Policy.

9. Third-party services

Kunbaa relies on third-party providers for hosting, storage, payments, app distribution, analytics, advertising, sign-in, email, notifications, AI infrastructure, and support. Your use of those providers may also be subject to their terms or policies.

We are not responsible for third-party services that we do not control, including external links shared by users.

10. Availability and changes

We work to keep Kunbaa available and reliable, but we do not promise uninterrupted service. Features may change, improve, be limited, move behind a plan, or be removed over time.

Some features may be beta, preview, region-limited, platform-limited, or subject to store approval and operational requirements.

11. Suspension, termination, and deletion

We may suspend or terminate access, remove content, or limit features if you break these Terms, create risk for other users, create legal or security risk, fail to pay amounts due, or misuse the service.

You may stop using Kunbaa at any time. Deleting your account or content may not immediately remove every copy from backups, logs, legal records, billing records, or family spaces where another admin or member still has lawful access.

12. Kunbaa intellectual property

Kunbaa and its software, design, branding, documentation, and content are owned by Kunbaa, VRITUL PTY LTD, or our licensors. These Terms do not give you ownership of our intellectual property.

You may not copy, modify, distribute, sell, or lease any part of Kunbaa unless we allow it in writing or the law allows it.

13. Disclaimers and limits

To the extent permitted by law, Kunbaa is provided on an "as is" and "as available" basis. We do not guarantee that every feature will always be error-free, uninterrupted, secure, or suitable for every purpose.

To the extent permitted by law, Kunbaa and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, use, or family records.

Some laws do not allow certain exclusions or limitations. In those cases, the exclusions and limits apply only to the maximum extent permitted by law.

14. Governing law

These Terms are governed by the laws of Victoria, Australia, unless mandatory local consumer laws require otherwise. Courts located in Victoria, Australia will have non-exclusive jurisdiction, subject to any rights you have under applicable local law.

15. Changes to these Terms

We may update these Terms as Kunbaa changes, as laws or platform requirements change, or as we add new features. We will update the date above and, where required, provide additional notice.
