Terms of Service

These Terms of Service ("Terms") govern your access to and use of Kunbaa.com and any associated apps, features, and services (collectively, the "Service") including Memory Lane, the Family Tree builder, Event Composer, Guru (AI), Living Portraits, private chat, and any future mobile apps or APIs. The Service is operated by Cosmos Innovations, a branch of Vritul Pty Ltd ("Kunbaa", "we", "our", or "us"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

0. What Kunbaa provides

Kunbaa is a private family network combining a living family tree, Memory Lane archive, and coordination tools so relatives can share stories without public social feeds. Depending on your plan, the Service may include AI features, cloud media storage, family chat, quick links, and integrations. Some functionality is available only to members invited to a specific family circle or paid plan.

1. Other terms that apply

These Terms incorporate by reference our Privacy Policy, Cookie Notice, and any feature-specific guidelines we publish (together, the "Policies"). Please read them carefully to understand how we handle your data and what we expect from users.

2. Eligibility & accounts

  • You must be at least 13 years old (or the minimum age required by your jurisdiction, if higher). If you are under 18, you must have parental or guardian consent.
  • You must provide accurate information and keep your login credentials confidential. You are responsible for all activity under your account.
  • Notify us immediately of unauthorized use or a suspected security incident at privacy@kunbaa.com.

3. Your content & license to us

You own the content you upload, post, or otherwise make available through the Service ("User Content"). To operate and improve the Service, you grant Kunbaa a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify, adapt, translate, display, perform, and distribute your User Content only as needed to provide the Service and its features (including backups, reformatting for display, moderation, and search).

You are responsible for your User Content and must have all necessary rights to grant the above license. You may delete your User Content at any time; however, cached copies may persist for a reasonable period and copies shared by others may remain accessible.

4. Content standards

Do not post, upload, transmit, or share content that:

  • Includes pornography, explicit sexual content, gratuitous violence, or other content that is indecent or unlawful.
  • Violates the privacy, publicity, or confidentiality rights of others, including posting personal data about others without consent.
  • Infringes intellectual property or other rights (e.g., copyrights, trademarks). Only post content you have the right to use.
  • Is defamatory, deceptive, discriminatory, hateful, harassing, threatening, or is reasonably likely to cause distress.
  • Contains malware, viruses, or other malicious code, or attempts to gain unauthorized access to the Service.
  • Breaches our Policies or any applicable law.

5. Reporting & moderation

If you believe content on the Service is unlawful or violates these standards ("Improper Content"), report it to privacy@kunbaa.com. By submitting a report, you confirm in good faith that the information is accurate.

We may remove content, restrict or terminate accounts, or take no action, in our reasonable discretion. We will notify you of our decision when practicable. You may appeal a moderation decision by replying to our notice.

We may disclose information if required by law or to protect users, the public, or Kunbaa.

6. Prohibited uses

  • Impersonating others or misrepresenting your affiliation with any person or entity.
  • Scraping, crawling, harvesting, bulk-downloading, or creating a competing database from Service content.
  • Running macros, scripts, or automation that abuses or degrades the Service.
  • Reverse engineering or attempting to access the Service or its systems without authorization.
  • Sending spam or unsolicited communications.
  • Commercializing the Service or reselling access without our prior written approval.

7. AI & automated features

  • AI features (Guru, Living Portraits, auto-tagging, Event Composer) process content you explicitly submit. They inherit your family circle permissions.
  • Unless stated otherwise, we run models within Kunbaa-controlled infrastructure and do not use your content to train public models.
  • Some AI experiences may rely on trusted partners. We will clearly disclose those integrations and require your consent before sending content to a partner model.
  • You are responsible for reviewing AI outputs before sharing them. Do not rely on automated suggestions for legal, medical, or safety decisions without human review.

8. Subscriptions & billing

  • Free plan usage includes limited storage and core collaboration tools. Premium plans unlock AI, Living Portraits, additional storage, and priority support.
  • Fees are billed in advance. Taxes may apply. Unless otherwise stated, subscriptions renew automatically until canceled.
  • Canceling stops future charges but does not grant refunds unless required by law. You retain access until the end of the billing period.
  • We may adjust prices with advance notice. Continued use after the effective date constitutes acceptance.

9. Data deletion & backups

  • You may delete individual posts, tree entries, or entire families via in-app controls. Deletions propagate to our active systems within 30 days and to backups within 90 days.
  • If you close your account, we mark associated content for removal unless another family admin retains it. Shared content may remain accessible to relatives who already downloaded or copied it.
  • We reserve the right to retain certain records for legal, security, or billing purposes.

10. Service changes

We may modify, suspend, or discontinue any feature (including free plan limits) at any time, with reasonable notice when practicable. If a paid feature is materially downgraded, you may cancel for a prorated refund.

11. Our intellectual property

The Service, including its software, design, trademarks, and other materials, is owned by Kunbaa or our licensors and is protected by law. Except for rights expressly granted in these Terms, no rights are transferred to you. You may not copy, modify, distribute, reverse engineer, or create derivative works of the Service.

12. Copyright complaints (DMCA)

If you believe material on the Service infringes your copyright, send a notice to our Copyright Agent at copyright@kunbaa.com with the information required by the Digital Millennium Copyright Act (17 U.S.C. §512). Knowingly submitting false claims may carry legal consequences.

13. Term & termination

We may suspend or terminate your access to the Service at any time, with or without notice, including for actual or suspected violations of these Terms or our Policies. You may stop using the Service at any time. Sections that by their nature should survive termination will survive (including ownership, disclaimers, limitations of liability, and dispute resolution).

14. Disclaimers

The Service is provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, availability, security, or accuracy. You are solely responsible for your use of the Service and your interactions with others.

15. Limitation of liability

To the maximum extent permitted by law, Kunbaa and its affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, data, or goodwill. Our total liability for any claim arising from or relating to the Service is limited to the greater of AUD $100 or the amounts you paid us for the Service in the 12 months before the claim.

16. Indemnification

You will defend, indemnify, and hold harmless Kunbaa and its affiliates, directors, employees, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to your User Content, your use of the Service, or your violation of these Terms or applicable law.

17. Changes to the Service or these Terms

We may modify the Service or these Terms from time to time. If we make material changes, we will provide notice by posting the updated Terms and updating the "Last updated" date. Changes take effect when posted unless stated otherwise. Your continued use of the Service constitutes acceptance of the changes.

18. Governing law & venue

These Terms are governed by the laws of New South Wales, Australia, without regard to conflict-of-laws rules. You and Kunbaa submit to the exclusive jurisdiction of the courts located in New South Wales for any dispute arising out of or relating to these Terms or the Service.
