Terms of Service

Template notice — legal review required before launch

These Terms are a plain-English template prepared to describe how Kunbaa is intended to work. They are not legal advice and have not yet been reviewed by a qualified lawyer. A licensed legal professional must review and adapt these Terms for each jurisdiction where Kunbaa launches before they are relied upon.

These Terms of Service ("Terms") govern your access to and use of Kunbaa, operated by Vritul Pty Ltd, a company registered in Australia ("Kunbaa", "we", "us", or "our"), including the website, mobile apps, family tree tools, memories, posts, announcements, chat, calls, invites, events, tasks, AI-written family digests, connected AI clients, billing, and optional paid features (together, the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility and age

  • You must be at least 18 years old to create an account or use the Service. Kunbaa is an adults-only service and is not directed to children. We do not offer child or teen accounts, and you may not create an account for, or let your account be used by, anyone under 18.
  • Children and other minors take part in Kunbaa only as information an adult family member chooses to record — for example a person in a family tree, or a photo or memory an adult uploads. An adult who adds information about a child is responsible for having the authority to share it and for how it is used in their family space.
  • You may not use the Service if you are barred from doing so under the laws that apply to you.

2. Your account

  • You must provide accurate account information, keep your sign-in methods secure, and tell us promptly if you believe your account has been compromised.
  • Kunbaa may link approved sign-in methods, such as email, mobile, Google, or Facebook verification, to the same account when the information matches.
  • You are responsible for activity on your account and for choosing relatives carefully when you invite them into a family space.
  • You may not share, sell, or transfer your account, and you may not impersonate another person or misrepresent your relationship to a family.

3. Family spaces, roles, and permissions

Kunbaa is built for private family collaboration. A family space may include family trees, member profiles, posts, memories, chat, calls, events, tasks, billing context, and other shared information.

  • Only share information you have the right to share.
  • Family admins and invited members may have different controls depending on the product surface and settings available at the time. Where available, a family admin can set each member's access level (admin, editor, or viewer) and switch individual permissions — posting on the family wall, adding people to the tree, and messaging family members — on or off per member, and a member can ask an admin for a permission they do not hold. An author may also narrow a post to their extended family or their household, as recorded on the family tree; Kunbaa applies that choice on its servers wherever the post can appear.
  • You must respect the access settings, privacy expectations, and boundaries of other family members.
  • Do not add, share, or expose information about another person unless you have the right or appropriate permission to do so.
  • Where we make it available, you may bring people onto your family tree from a file you already hold — a family-tree file in GEDCOM format exported from another genealogy product, or a chat export made by WhatsApp. The file is one you choose; it is read in your browser or on your device and is not uploaded to Kunbaa; no message in a chat export is read, sent, or kept; and only the people, relationships, and dates you confirm are written to your family tree, through the same steps as adding a relative by hand. Adding people this way needs the same access as adding them by hand, and you are responsible for having the right to add the people it names, exactly as in the previous bullet.
  • If location or Family Safety features are available to you, use them only with clear consent from the people involved. Location data is best-effort and cannot be guaranteed accurate, current, or available, so do not rely on it for safety-critical decisions. Kunbaa is not an emergency monitoring or dispatch service — in an emergency, call your local emergency number and rely on official emergency services.
  • Use extra care with children's information, elder care notes, health details, identity documents, financial information, adoption context, family conflict, or other sensitive matters.

4. Your content and the license you grant

You keep ownership of the content you upload, post, send, or add to Kunbaa, including names, photos, videos, documents, recipes, voice notes, stories, messages, comments, events, tasks, family-tree details, and the people and details you confirm from a file you import ("Your Content").

You grant Kunbaa a limited, worldwide, non-exclusive, royalty-free license to host, store, process, display, transmit, back up, secure, and format Your Content as needed to operate, protect, improve, and support the Service. This includes actions such as generating thumbnails, syncing across devices, delivering notifications, rendering family trees, enabling search, and sharing Your Content with the relatives you choose. This license exists only to run the Service for you and your family, ends when Your Content is deleted from active systems (subject to backups and the retention periods in our Privacy Policy), and does not permit us to sell Your Content or use it to target advertising.

You are responsible for making sure Your Content is lawful, accurate enough for the use you make of it, and does not infringe another person's rights.

5. Private by default

Kunbaa is private by default. Your family space is shared with the relatives you invite and the members who already have access — not with the public. We do not sell your personal data, and we do not use private family content to target advertising. Any advertising is limited to public marketing pages, as described in our Ads & Monetization Policy.

6. Acceptable use

You agree not to misuse Kunbaa. For example, you must not:

  • Break the law or violate another person's rights.
  • Upload malware, spam, abusive content, deceptive content, or anything designed to disrupt the Service.
  • Harass, threaten, impersonate, exploit, or deceive other people through Kunbaa.
  • Scrape, copy in bulk, reverse engineer, overload, or try to access parts of Kunbaa you are not allowed to use, or attempt to circumvent security, rate limits, or usage limits.
  • Share an access token for a connected AI client with anyone else, use one to reach data or families your own account is not permitted to see, or run a connected client in a way designed to overload Kunbaa or evade its rate limits (Section 9).
  • Use Kunbaa for emergency response, professional medical advice, legal advice, financial advice, or safety-critical decisions.
  • Upload content that exploits or endangers children, violates privacy, promotes violence, or is otherwise unlawful or harmful.

7. Calls, messages, invites, and user content

Kunbaa may let you send invitations, messages, announcements, comments, reactions, call requests, push notifications, and related family communications. You are responsible for using these features respectfully and lawfully.

If you invite someone from your contacts, make sure you are comfortable sending that invitation and sharing the related family context with that person.

Where we make it available, Kunbaa may create and maintain family group chats from the relationships recorded on your family tree — for example a household, a set of siblings, or an extended family. Who belongs to such a group follows the tree and is kept in step with it by Kunbaa: it is not edited by hand, and the group cannot be renamed or left while it exists. If we switch the feature off, existing groups stay readable and nothing in them is deleted by that switch. Groups you create yourself are unaffected.

Calls depend on device permissions, network quality, and third-party infrastructure. Calls are voice and video calls in the mobile app — one-to-one, or a group of up to 4 people including the person who starts it on the free plan and up to 6 on Kunbaa Plus — between members of the same family space; they may be unavailable, delayed, or limited by release profile, plan, platform, or local connectivity, and must not be used for emergency communications. Calls are not recorded, transcribed, or stored by Kunbaa.

We may, but are not obligated to, review, moderate, limit, or remove content that we reasonably believe violates these Terms or the law, or that is reported to us. You can report content or a member through the in-product tools where available, or by contacting us.

8. AI-written family digests

Kunbaa's own AI, Kunbaa AI, does one thing: it writes family digests — short, periodic recaps of the family updates you missed, drawn from your own family's tree, memories, posts, and events. Kunbaa writes and sends them to you; Kunbaa has no conversational assistant, no AI voice, and no screen of its own that accepts a prompt. Digests are included for every account at no cost, and nothing AI-related is offered for sale. An AI client you connect yourself under Section 9 is a different thing: it is your app, not Kunbaa's AI, and this section does not describe it.

  • Read-only. A digest summarises. Kunbaa's AI never posts, comments, messages anyone, creates an event or task, or changes your family tree. Every change inside your family space is made by a person — including any change a connected AI client proposes, which happens only when you confirm it (Section 9).
  • Permission-scoped. A digest is written only from what your own signed-in account is already permitted to see, through the same access rules that apply to you.
  • No reliance. AI output may be incomplete, inaccurate, or outdated. A digest is a convenience summary, not a record — the family updates behind it stay readable in the app, and you remain responsible for checking them before you act on a summary.
  • Do not rely on AI output alone for health, legal, financial, safety, emergency, or other high-stakes decisions.
  • Delivery, metering, and availability. Digests reach you only as notifications, so declining the notification permission means none will arrive. Digest generation is metered: we apply technical guardrails such as usage budgets, rate limits, and abuse-prevention checks, and if a budget is exhausted a digest may be shortened, delayed, or skipped until the allowance resets. These are operational limits, not a plan entitlement — digests are included for every account, free and paid alike. The frequency, coverage, and availability of digests may also change or be limited by platform, territory, or feature status.

9. Connected AI clients

Kunbaa may let you connect a third-party AI client that supports the Model Context Protocol (MCP) — for example a desktop AI assistant or an AI coding tool — so that it can read, and with your confirmation act on, your Kunbaa data. This is optional, may be hidden or unavailable in some release profiles or regions, and is provided for your own personal use. The client is yours: Kunbaa provides the connection, not the client, and is not affiliated with, does not select, and does not control any client or the AI provider behind it. Our Privacy Policy (Section 9) explains what a connected client can read and where the data goes.

  • Your tokens, your responsibility. A connected client works only with an access token you create on kunbaa.com or in the Kunbaa app, limited to the permissions you choose, revocable by you at any time, and valid for no more than 90 days. You are responsible for every token you create, for every client you connect, for keeping tokens secret, and for what those clients and their providers do with the data they receive. Treat a token like a password: do not share it, and revoke it immediately if you think it has been exposed. Your relatives are not asked when you connect a client, so use connected clients consistently with Section 3 and with what your family reasonably expects of you.
  • What a client can read. Only the categories you allowed, only what your own account is already permitted to see, and in every family your account belongs to. Family chat cannot be read by a connected client in this release.
  • Two-step confirmation for changes. A connected client cannot change anything on its own. With the matching permission it may propose a new event, task, post, goal, or family-tree person. Kunbaa holds the proposal for a short time and creates the item only after you confirm that specific proposal in the client; if you do not, it expires and nothing is created. Kunbaa creates the proposal you approved, not something the client sends afterwards. A confirmed change is attributed to you as if you had made it yourself, requires the family role a person would need to make it, and is Your Content under Section 4. A connected client cannot send messages, comment, delete, invite, start calls, or change family or privacy settings.
  • Where the AI runs. The reasoning behind what a connected client says or proposes happens in that client and on its AI provider, not on Kunbaa. Kunbaa's part is to serve the data the token allows, to check and hold a proposal, and to create the item you confirm. Kunbaa does not warrant, and is not responsible for, the client's reasoning or output.
  • Automated content check. Before Kunbaa stores anything a connected client proposes, the proposed text is run through an automated content check as described in Section 9 of our Privacy Policy. Kunbaa will refuse, and not store, a proposal that fails the check or that cannot be checked, and may suspend connected-client access for an account whose proposals repeatedly fail it. Nothing in this bullet limits Section 6.
  • Monthly allowance for AI-created events. On the free plan, a connected client may create one event a calendar month (counted in UTC, when you confirm the proposal). Kunbaa Plus — your own subscription, or a relative's that covers your family under Section 10 — removes that limit. Proposals that are refused or that you do not confirm are not counted, unused allowance does not carry over, the allowance is not a purchase or a credit, and events you add yourself in the app are not limited or counted. Kunbaa may change the allowance under Section 14, and will not reduce it for an existing user without at least 30 days' notice.
  • Your agreement with the provider. Kunbaa sends the data a client is allowed to read to that client. What the client and its AI provider then do with it — including sending it to the provider's models — is governed by your agreement with them, not by these Terms and not by the commitments about Kunbaa's own AI providers in our Privacy Policy.
  • No reliance. The no-reliance and high-stakes cautions in Section 8 apply to anything a connected client produces from your Kunbaa data. Its output is not a Kunbaa record, may be incomplete, inaccurate, or outdated, and you remain responsible for checking it before you act on it or confirm a change based on it.
  • Limits, suspension, and revocation. Connected-client access is rate-limited per token and per account. Kunbaa may revoke any token, suspend or disable a connected client, or turn connected-client access off for everyone, at any time and without notice, for security, abuse, legal, or operational reasons, and may change or remove the feature under Section 14. Revoking a token stops future access; it does not recover anything a client already received.
  • As is. Connected-client access is provided "as is" and "as available" under Section 16, and Section 17 applies. To the extent permitted by law, Kunbaa is not responsible for a connected client, its provider, or any loss caused by how you or they use a token or the data it returns.

10. Subscriptions, billing, and refunds

  • Kunbaa is free to join and use. The family tree, the family wall, chat, voice and video calls, events and Family Safety are available to every member of a family on the free plan. What a paid plan changes is how much a family can keep, and for how long — the limits set out in the four bullets below — rather than which parts of Kunbaa a member can open.
  • Photos and videos sent in chat, on the free plan. A photo or video sent in a Kunbaa chat is stored on our servers for 12 months from the time it was sent, and may then be removed. This applies only to media sent in chat: nothing posted to the family wall, an event or a person's profile is affected. Before that window ends, a member who administers or edits the family can save the file into the family archive, where it is kept under the same terms as the rest of the archive. When a file does expire, the message itself remains and a placeholder tells you the file is no longer kept; we mark it expired and then allow at least 14 days before the file is actually removed from storage, so a family that notices in time can still ask us to keep it. The copy your own phone has already downloaded lives in your device's cache, which your phone may clear at any time — it is not a backup, and we cannot restore it.
  • Photos and videos sent in chat, on Kunbaa Plus. While a family is on Kunbaa Plus, photos and videos sent in its chats are kept in the family archive rather than expiring. A file kept while the family was on a paid, settled subscription stays kept permanently: if the subscription later lapses, that file is never put back on an expiry clock. Files sent after a subscription ends follow the free plan's 12-month window.
  • Forward-only. This retention rule applies only to media sent in chat after we switched it on. Media already stored before that date, and media that carries no chat marking, is treated as archive content and can never expire under this clause.
  • Video length in the family archive. On the free plan, videos added to the family archive must be short clips, and a longer video is refused at upload with a message that says so — nothing is silently truncated or re-encoded to fit. On Kunbaa Plus, longer videos are accepted, up to the maximum file size the platform supports. Refusing an upload never affects anything already in your family's archive.
  • At least 30 days' notice before we shorten anything. If we change these Terms or our practice in a way that shortens how long your family's content is kept, we will tell you at least 30 days before it takes effect — by email to the address on your account, and on kunbaa.com — so that you can save what matters, export your archive, or cancel first. This is in addition to the price-change notice below.
  • One plan, two billing intervals. Kunbaa Plus is sold monthly or yearly, and you choose the interval at checkout. One person pays for the plan; everyone else in that family uses Kunbaa free and never needs a payment method.
  • Where you can buy it. A paid plan may be bought on the Kunbaa website at kunbaa.com, and through any app store where we make it available. The price, currency, taxes and renewal terms that apply to you are the ones shown to you at checkout, on the rail you bought through. Store prices are set in your local currency and may include tax, so they will not always match the figure shown on kunbaa.com.
  • Who charges you, and who you cancel with. If you subscribe on kunbaa.com, Stripe processes the payment and you manage or cancel the subscription from your account under Settings → Plans → Manage billing, which opens the secure Stripe billing portal. If you subscribe through an app store, that store charges you under its own terms, and you manage, change and cancel that subscription in that store's account settings — Kunbaa cannot cancel it or refund it for you. Kunbaa does not store your card details in either case.
  • Apple Family Sharing. Apple Family Sharing is enabled for Kunbaa Pluson the App Store. If a member of your Apple family group shares their App Store subscription with you under Apple's Family Sharing, it unlocks Kunbaa Pluson your Kunbaa account the same way as your own purchase would, for as long as Apple reports that share as active. That is Apple's mechanism, run under Apple's terms, and it is separate from Kunbaa's own family plan: one person pays for Kunbaa Plusand everyone in that Kunbaa family uses it free, whether or not they belong to the buyer's Apple family group.
  • Free trial, where offered. A first paid subscription includes a free trial period — currently 30 days, and always shown at checkout before you confirm. A payment method is required to start a trial, and unless you cancel before the trial ends, the subscription begins and the first charge for your chosen interval is made automatically. Trials are not offered on discounted early-bird purchases, or to accounts that have subscribed before. Trial length and availability may differ on an app store, and what that store shows you at checkout governs.
  • Auto-renewal. Subscriptions renew automatically for a further month or year, matching the interval you chose, until you cancel. Cancel before the next renewal, with whoever bills you.
  • Price changes. You keep the price you subscribed on. If we change what a plan costs, we will give you at least 30 days' notice before it affects you — by email to the address on your account, and on kunbaa.com/pricing — so that you can cancel before the new price applies. We will not change the price of a billing period you have already paid for. Where an app store requires its own consent step for a price rise, that step applies in addition to this notice.
  • You can cancel at any time. Cancelling stops future renewals and takes effect at the end of the period you have paid for; there is no cancellation fee and no minimum term. It does not by itself refund a billing period that has already started, unless a refund is required by law. Refunds for a purchase made through an app store are handled by that store under its own policy. Your family's archive is not deleted when a paid plan ends: content your family has already added stays readable to your family, files kept while you were on Kunbaa Plusstay kept, and what changes is what happens next — adding is limited to the free storage allowance, archive videos return to short clips, and photos and videos sent in chat from then on follow the free plan's 12-month window.
  • You can take your archive with you. You can ask us for a complete copy of your family's content at any time, on any plan including free, and we will prepare it for you. A self-serve export is being built; until it ships, the request goes through our support address. We do not charge for this and we do not require you to keep paying to get your own content out.
  • Deleting your account does not cancel a store subscription. If you subscribed through an app store, you must cancel it in that store, otherwise it keeps renewing and you keep being charged even after your Kunbaa account is gone. A subscription bought on kunbaa.com is cancelled as part of deleting your account.
  • Fair use of the shared archive. A paid plan provides shared storage sized for an ordinary family's archive, not unlimited storage. We may apply a fair-use ceiling to a family's shared space and adjust it over time as storage costs change; your usage page always shows where your family stands against the current one, and warns you before it is reached. Reaching it pauses new uploads — it never deletes anything already in your family's space, and it never blocks a chat message from going through.
  • Storage allowances and included features may change over time. We will give notice of material changes as required by law, and where a change would shorten how long your family's content is kept, the 30-day notice above applies.
  • Billing on kunbaa.com is offered only in supported territories. If we cannot lawfully sell to the country you are in, checkout will tell you so rather than complete.
  • Nothing in these Terms limits non-excludable rights you may have under consumer protection laws, including the Australian Consumer Law where it applies.

11. Public website monetization

Kunbaa may monetize public website pages with advertising, sponsorships, affiliate links, analytics, or campaign measurement where permitted by law and consent choices. Sponsored or affiliate placements should be labeled when used.

Signed-in family trees, private chats, private posts, private media, private events, private tasks, billing screens, and family admin areas are not third-party ad inventory. Read more in our Ads & Monetization Policy.

12. Third-party services

Kunbaa relies on third-party providers for hosting, storage, payments, app distribution, analytics, advertising, sign-in, email, notifications, AI infrastructure, and support. Your use of those providers may also be subject to their terms or policies.

Payments are processed by Stripe on kunbaa.com, and by Apple or Google for a subscription bought in their app stores. Where a plan is sold in an app store, we use RevenueCat to record the purchase and keep your entitlement in step with that store; RevenueCat receives the purchase and subscription records that come from the store, not your payment details.

AI clients and assistants that you choose to connect to your account under Section 9 are not Kunbaa's providers. You choose them, they run outside Kunbaa, and they are outside our control; your use of them is governed by their terms and by your agreement with their providers.

We are not responsible for third-party services that we do not control, including external links shared by users and AI clients you connect.

13. Kunbaa intellectual property and feedback

Kunbaa and its software, design, branding, documentation, and content are owned by Vritul Pty Ltd or our licensors. These Terms do not give you ownership of our intellectual property.

You may not copy, modify, distribute, sell, or lease any part of Kunbaa unless we allow it in writing or the law allows it.

If you send us feedback or suggestions, you grant us a perpetual, irrevocable, royalty-free license to use them to improve the Service, without obligation to you.

14. Availability and changes

We work to keep Kunbaa available and reliable, but we do not promise uninterrupted service. Features may change, improve, be limited, move behind a plan, or be removed over time.

Some features may be beta, preview, region-limited, platform-limited, or subject to store approval and operational requirements.

15. Suspension, termination, and deletion

We may suspend or terminate access, remove content, or limit features if you break these Terms, create risk for other users, create legal or security risk, fail to pay amounts due, or misuse the Service.

You may stop using Kunbaa at any time and may delete your account as described on the account deletion page. Deleting your account or content may not immediately remove every copy from backups, logs, legal records, billing records, or family spaces where another admin or member still has lawful access, as described in our Privacy Policy.

16. Disclaimers

To the extent permitted by law, Kunbaa is provided on an "as is" and "as available" basis. We do not guarantee that every feature will always be error-free, uninterrupted, secure, or suitable for every purpose.

Location and Family Safety information is provided for convenience only and cannot be guaranteed to be accurate, complete, current, or continuously available. GPS, device settings, connectivity, and other factors can delay, omit, or misplace a location. Kunbaa is not an emergency, security, or safety-monitoring service and must not be relied on in an emergency; always contact your local emergency number and official emergency services.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot lawfully be excluded, including under the Australian Consumer Law.

17. Limitation of liability

To the extent permitted by law, Kunbaa and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, use, or family records.

To the extent permitted by law, our total liability arising out of or relating to the Service is limited to the greater of the amount you paid us for the Service in the twelve months before the event giving rise to the claim, or one hundred Australian dollars (AUD 100).

Some laws do not allow certain exclusions or limitations. In those cases, the exclusions and limits apply only to the maximum extent permitted by law, and where a consumer guarantee applies, our liability may be limited to re-supplying the Service or paying the cost of re-supply.

18. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Vritul Pty Ltd and its affiliates, officers, and staff from claims, damages, losses, and reasonable expenses (including legal fees) arising out of content you upload, your use of the Service, the access tokens you create and AI clients you connect under Section 9, your breach of these Terms, or your violation of the law or another person's rights. This does not apply to the extent a loss is caused by us or cannot lawfully be shifted to you.

19. Governing law

These Terms are governed by the laws of Victoria, Australia, unless mandatory local consumer laws require otherwise. Courts located in Victoria, Australia will have non-exclusive jurisdiction, subject to any rights you have under applicable local law.

20. Dispute resolution

If you have a concern, please contact us first at privacy@kunbaa.com so we can try to resolve it informally. Most concerns can be settled quickly this way.

If we cannot resolve a dispute informally, the parties will work in good faith to resolve it, and either party may pursue available remedies in the courts identified in Section 19. Nothing in this section prevents you from raising a complaint with a consumer protection or data-protection regulator, or from exercising any non-excludable right you have under local law.

21. General

  • Entire agreement. These Terms, the Privacy Policy, and the Ads & Monetization Policy are the entire agreement between you and Kunbaa about the Service.
  • Severability. If any provision is found unenforceable, the rest of the Terms remain in effect.
  • No waiver. Our failure to enforce a provision is not a waiver of our right to do so later.
  • Assignment. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets.
  • Notices. We may provide notices through the app, by email, or on our website.
  • Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control.

22. Changes to these Terms

We may update these Terms as Kunbaa changes, as laws or platform requirements change, or as we add new features. We will update the effective date above and, where required, provide additional notice. Your continued use of Kunbaa after an update takes effect means you accept the revised Terms.
